1. Acceptance of Terms

By downloading, installing, or using the PulseAnvil application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User", "you") and PulseAnvil ("we", "our", "us"). Your use of the App is also governed by our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

PulseAnvil is a fitness tracking and workout management application designed for iPhone and Apple Watch. The App provides: • Custom workout builder and logging • Real-time heart rate zone monitoring via Apple Watch • Workout history, progress analytics, and personal records • Progress Selfie feature for visual body transformation tracking • Health data integration via Apple HealthKit • Cross-device data sync via Apple CloudKit • Optional premium features available via in-app subscription The App is available exclusively on Apple devices running iOS 16.0 or later and watchOS 9.0 or later.

3. Eligibility

You must be at least 13 years of age to use PulseAnvil. By using the App, you represent and warrant that you are 13 years of age or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App is not intended for use by individuals under 13 years of age. If we become aware that a user is under 13, we will take steps to remove their account and data promptly.

4. Account & Authentication

PulseAnvil uses Sign in with Apple for authentication. By creating an account, you agree to: • Provide accurate information during sign-in • Maintain the security of your Apple ID credentials • Accept responsibility for all activity that occurs under your account • Notify us immediately at anvilcrew@pulseanvilfitness.com if you suspect unauthorized access We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or compromise the security of other users.

6. HealthKit & Health Data

PulseAnvil accesses Apple HealthKit solely to provide fitness tracking features. By granting HealthKit access, you acknowledge: • Your health and fitness data is stored on your device and in your personal iCloud account — never on PulseAnvil servers. • PulseAnvil will not use HealthKit data for advertising, marketing, or sale to third parties. • You can revoke HealthKit access at any time in iPhone Settings → Privacy & Security → Health → PulseAnvil. • Removing HealthKit access will disable certain core tracking features of the App. PulseAnvil complies with all Apple HealthKit guidelines. Health data provided by the App is for informational purposes only and does not constitute medical advice.

7. Photo Access & Progress Selfies

The Progress Selfie feature requires access to your device's photo library. By enabling this feature, you acknowledge: • Photos are accessed only when you explicitly choose to use the Progress Selfie feature. • All progress photos are stored on your device and/or in your personal iCloud account via CloudKit — never uploaded to PulseAnvil servers. • You are solely responsible for the photos you capture or select. Do not upload photos that contain content that is unlawful, offensive, or violates the rights of others. • You retain full ownership of all photos you take. PulseAnvil claims no ownership or licence over your photos. • You can delete individual selfies within the App or revoke photo access in iPhone Settings → Privacy & Security → Photos → PulseAnvil.

8. Acceptable Use

You agree not to use PulseAnvil to: • Violate any applicable law or regulation • Interfere with or disrupt the App's functionality or servers • Attempt to gain unauthorised access to any part of the App or its infrastructure • Reverse-engineer, decompile, or disassemble the App or any portion thereof • Use the App for commercial purposes without our written consent • Impersonate any person or entity We reserve the right to terminate access for users who violate these rules without notice or refund.

9. Intellectual Property

All content, features, and functionality of PulseAnvil — including but not limited to the App design, graphics, logos, text, workout templates, and software code — are the exclusive property of PulseAnvil and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes strictly in accordance with these Terms. This licence does not include the right to sublicense, copy, modify, or distribute the App or its content.

10. Health & Medical Disclaimer

PulseAnvil is a fitness and wellness tool designed for general informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. • Consult a qualified healthcare professional before beginning any new exercise programme, especially if you have a pre-existing medical condition. • Heart rate and biometric data displayed in the App are estimates and may not be medically accurate. • Do not rely solely on PulseAnvil data to make health or medical decisions. PulseAnvil expressly disclaims any liability arising from your reliance on App data for medical purposes.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PULSEANVIL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any data or content will be accurate, reliable, or complete.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULSEANVIL AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to PulseAnvil in the twelve (12) months preceding the claim.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App that cannot be resolved informally shall be subject to binding arbitration in accordance with the American Arbitration Association rules. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we will notify you via an in-app notice. Your continued use of PulseAnvil after any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the App.
